1. Scope
This document describes the legal delineation of roles and the allocation of liability between basebox GmbH and the users (customers) of the basebox AI Management System.
It serves compliance with the transparency and information obligations under the EU Artificial Intelligence Act (Regulation (EU) 2024/1689).
2. Roles under the EU AI Act
basebox GmbH acts as SUPPLIER / INFRASTRUCTURE PROVIDER within the meaning of Article 3 No. 23 EU AI Act.
The customer is considered:
– DEPLOYER (Article 3 No. 4) when operating the system or using it with models. – PROVIDER (Article 3 No. 2) insofar as the customer trains, fine-tunes or publishes their own models.
3. Boundaries of responsibility
basebox provides exclusively the technical infrastructure, consisting of:
– the management environment (software), – the optional provision of selected open-source models (e.g. Llama 3.3 70B in quantised form), – interfaces (REST API, RAG components).
Responsibility for:
– selection, configuration and use of the models, – the processing and input of data, – compliance with data protection, employment and security law, – and the proper operation of the system
lies entirely with the customer.
4. Limitation of liability
basebox is not liable for decisions, content or results arising from the use of models.
Likewise, there is no liability for damage caused by incorrect input, unsuitable use cases, unauthorised modifications or the loading of the customer's own models.
Use takes place on the basis of the respective model and software licences of the original developers. These licences must be complied with by the customer.
5. Closed-source models
Closed-source models (e.g. the OpenAI GPT and Anthropic Claude series) are not part of the basebox distribution.
Procurement and use of such models is the customer's own responsibility, including all licence, data protection and export obligations.
6. Changes by the customer
If a model is retrained, fine-tuned, modified or made publicly available by a customer, the customer automatically assumes the role of provider under Article 3 No. 2 EU AI Act and bears the associated obligations (documentation, conformity assessment, CE marking, etc.).
7. Availability and security
basebox ensures that the shipped models and software components contain no known prohibited practices under Article 5 EU AI Act. A continuous technical review takes place before each release.
